Hello there beautiful readers! Welcome to another enlightening session on Knowledge Tent.

So far, we have been discussing on ‘The Basics’, which comprises the Fundamental Human Rights contained in Chapter 4 of the 1999 Constitution of the Federal Republic of Nigeria and today, this would be our final publication on ‘The basics’

Which means, a new series would begin!!!

More details can be found at the end of this publication, but for now, let’s move into our topic!

SECTION 43

This section provides that as a citizen of Nigeria, you have the right to acquire and own immovable property anywhere in Nigeria.

An example of an immovable property is land- However, in Nigeria, land is owned by the State Government, citizens can only occupy the land when they are granted a statutory right of occupancy in accordance with Section 5 of the Land Use Act, 1978.

SECTION 44

This section provides that no moveable property or any interest in an immovable property shall be taken possession of compulsorily.

And no right over or interest in any moveable or immoveable property shall be acquired compulsorily in any part of Nigeria except in the manner and for the purposes prescribed by a law, one of which is the prompt payment of compensation.
