Let’s learn!
In our previous discussion we learnt about Section 37- Right to Private and Family Life and we beleive it was an enlightening session
If you’ve not read our previous articles, you’re missing out! Do well to read them please
On a closer look at Section 37 of the 1999 Constitution, you would find out that the wordings of that Section only provides for the Right to Private life and not the right to family life.
Does this mean that you don’t have the Right to family life?
Wait, what is the Right to Family Life sef?
We’ve got you covered!
This involves your right to belong to a family and create a family. This means that:
- To the children reading this,you have the right to belong to a family and;
- To the big boys and girls, you also have the right to own family in your name and also to enjoy family relationships.
This is the right to belong to a family, to maintain family relationships, and it prohibits unlawful seperation of children from their parents.
With this brief explanation, it is clear that this right is important, however, omitted in the 1999 Constitution of the Federal Republic of Nigeria.
Does this mean that this right is not protected and recognised in Nigeria!?
Absolutely not!
Regardless of this erroneous exclusion in the Constitution, the right to family life is recognised and protected in Nigeria.
HOW?
As seen in Article 18 of the African Charter on Human and People’s Rights and Article 19 of the African Charter on the Rights and Welfare of the Child, the importance of a family is captured and these laws apply to citizens in Nigeria.
Thus, our right to family life is protected and recognised in Nigeria
