To Life.
In Nigeria, every human being is entitled to be alive, no life is expected to be unlawfully taken away.
We are all entitled to this right to life, which is contained in section 33 of the 1999 constitution of the Federal Republic of Nigeria(as amended).
This section explains that every person, every human being in Nigeria has a right to life, you, reading this article have a right to be alive and no one, absolutely no one, should be unlawfully deprived of their right of be alive!
For this right to be unlawfully deprived, it means that there is a legal provision for one to be deprived of this right.
HOW?
In the execution of a court sentence, in respect of a criminal offence which he/she has been found guilty of.
Criminal offences such as murder, rape, terrorisim e.t.c
Emphasis on the phrase “has been found guilty of".
Thus, unless it has been proven beyond reasonable doubt, and the court has given its final judgement, pronouncing an individual guilty of a criminal offence and stating that the offense committed warrant a capital punishment better known as a death penalty, such individual should not be deprived of this precious right.
Under the right to life, there are situations where it cannot be said that one was deprived of their right to life.
- Where an individual was killed while trying to escape from a prison. This is real life, not prison break series
- While running away from a lawful arrest.
Such individuals cannot be said to have been deprived of their right to life.
- Also, where an individual loses his life while causing unlawful violence to another individual or their property. It logically cannot be said that such person was deprived of their right to life.
Before stirring up the need for a riot, an insurrection or a mutiny, it is important to know that where individuals lose their lives while participating in such actions, it would not be said that they were deprived of their right to life.
Please note that there is a clear difference between a riot; insurrection; mutiny and a peaceful protest.
I fully believe and know that you have been educated on your right to life as a Nigerian Citizen and you now know when it can been deprived.
